You are eligible to take a defensive driving class if you have a valid Texas driver's license and you have not taken a defensive driving class within the last twelve (12) months immediately preceding the date of the alleged offense and are not currently taking the course for another traffic violation in the State of Texas.

Defensive driving may only be taken for ticket dismissal on moving violations. The following violations do not qualify for defensive driving:

  • Speeding 25 mph over the posted limit
  • Passing a stopped school bus
  • Moving violation within a posted construction zone while workers are present and
  • Violations committed while operating a commercial vehicle.

Defensive driving may not be requested or paid via the Internet. You may request defensive driving in person or through regular mail. Juveniles under the age of 17, however, must appear in open court with a parent or guardian.  Please mail defensive driving requests to:

COURT PROCEDURE

In order to request defensive driving by mail you must submit the following items:

FIRST: A letter in writing requesting defensive driving. You must reference your ticket number in your letter. Download a copy of the Request for Defensive Driving form using Adobe Reader.

SECOND: A photocopy of your Texas Liability Insurance. The proof of insurance must either be in your name or state that you are a policy member.

THIRD: Mail a check or money order made payable to the City of San Antonio; in the amount of the appropriate court fees listed below. Additional fees will apply if a warrant has been issued.

For violations occurring on or after September 1, 2003:
Speeding in a school zone $120.00
All other violations $95.00

For violations occurring before September 1, 2003:
Speeding in a school zone $90.00
All other violations $65.00

Defensive driving court costs may not be paid through the on-line fine payment system.

YOUR REQUEST MUST BE RECEIVED BY YOUR SCHEDULED APPEARANCE DATE. ONCE YOU ARE APPROVED BY THE MUNICIPAL COURT, YOU WILL RECEIVE A CONFIRMATION LETTER ALONG WITH FURTHER INSTRUCTIONS FOR COMPLETING YOUR REQUIREMENTS. PLEASE DO NOT TAKE A DEFENSIVE DRIVING COURSE UNTIL YOU HAVE BEEN APPROVED TO DO SO BY THE COURT.

COURT REQUIREMENTS

Upon approval by the court for defensive driving, you will receive a confirmation of approval with a list of requirements and your due date. Please do not complete any requirements until you have been approved by the court for defensive driving.

For proper ticket dismissal, you will be required to return three(3) items to the court on or before your due date.

  1. The first requirement is the court copy of your defensive driving certificate of completion. If you have not received or you have lost your defensive driving certificate, you may contact the Texas Education Agency at (512) 997-6523 for a duplicate copy. The Texas Education Agency will not be able to help you obtain a duplicate certificate until the 21st day has passed since you have taken the defensive driving course.

  2. The second requirement is a copy of your Texas Driving Record. If you have lost your Request for Driving Record form, you may download the request form using Adobe Reader. You may also request your driving record through Texas Online.

  3. The third requirement is a photocopy of proof of Texas Liability Insurance either in your name or stating that you are a policy member.

YOUR REQUIREMENTS MUST BE RECEIVED BY YOUR SCHEDULED DUE DATE. YOU MAY RETURN YOUR REQUIREMENTS IN PERSON OR MAIL THEM TO:

How do I qualify for defensive driving?

You must not have taken a defensive driving course within the last twelve months prior to receiving your ticket in the State of Texas, you must have liability insurance and a valid Texas driver's license. Defensive driving may only be taken for ticket dismissal on moving violations and speeding tickets less than 25 miles over the limit.

If you cannot appear on your court date, you may request defensive driving by mail. Someone else may appear for you if they have a letter from you allowing them to request defensive driving for you.

Do I have to wait for the driving record to return before I can take my defensive driving class?

No, you do not need to wait until you receive your driving record to take your class. If you have been approved by the Court to take defensive driving, you will need to obtain your driving record, which takes approximately six to eight weeks. During this time you may take your defensive driving class.

What proof is needed that I have completed my defensive driving class?

After taking the defensive driving class, two certificates of completion will be mailed to you. One of those certificates is an insurance copy and one is a court copy. The Municipal Court will need the court copy of your certificate as proof of completion. A receipt of payment from the class is not accepted as proof.
